Terms of Use
Last Updated: March 2025
Welcome to temoravixi. By accessing or using our website and services related to liquidity and solvency analysis, you're agreeing to these terms. Please read them carefully. If something doesn't sit right with you, we'd recommend not using our services until you've reached out to us for clarification.
1. Acceptance of Terms
These Terms of Use form a binding legal agreement between you and temoravixi. When you access temoravixi.com, register for our services, or participate in our educational programs, you're confirming that you've read and accepted these terms in full.
We update these terms occasionally to reflect changes in our services or legal requirements. The date at the top tells you when we last made changes. It's worth checking back periodically, though we'll make reasonable efforts to notify users of substantial changes through email or prominent website notices.
If you continue using our services after changes take effect, that means you accept the updated terms. Simple as that.
2. Service Description
temoravixi provides educational content, analysis tools, and resources focused on financial liquidity and solvency assessment. Our services are designed for professionals and learners in the Australian market who want to develop their understanding of these critical financial concepts.
Here's what we offer:
- Educational content about liquidity ratios, cash flow analysis, and solvency metrics
- Interactive learning materials and case studies based on realistic scenarios
- Access to analytical frameworks and assessment methodologies
- Community features for discussion and knowledge sharing
- Resources for ongoing professional development
What we don't provide: specific investment advice, legal counsel, or personalized financial planning. Our content is educational. You're responsible for how you apply what you learn.
3. User Obligations and Conduct
You agree to use our platform responsibly. That sounds obvious, but it's worth spelling out what that means.
3.1 Account Responsibilities
If you create an account with us, you're responsible for maintaining its security. Choose a strong password. Don't share your login credentials. If you suspect unauthorized access, let us know immediately at contact@temoravixi.com.
You must provide accurate information when registering. If your details change, update them. Using false information or impersonating others isn't just against our terms—it could be illegal.
3.2 Prohibited Activities
Don't do these things on our platform:
- Upload malicious code, viruses, or anything designed to disrupt our systems
- Attempt to gain unauthorized access to other users' accounts or our infrastructure
- Scrape or harvest data using automated tools without permission
- Post content that's defamatory, offensive, or infringes on others' rights
- Use our services for any unlawful purpose or to violate regulations
- Resell or redistribute our content without proper licensing agreements
- Interfere with other users' ability to access and enjoy our services
3.3 Professional Use
Our content is designed for educational and professional development purposes. While we aim for accuracy, financial markets and regulations change. You're expected to verify information and seek appropriate professional advice before making business decisions based on concepts learned through our platform.
4. Intellectual Property Rights
The content on temoravixi.com—including text, graphics, course materials, videos, and software—belongs to temoravixi or our content partners. It's protected by Australian and international copyright laws.
When you access our materials, you get a limited, non-exclusive license to use them for personal educational purposes. That's it. You can't reproduce, distribute, modify, or create derivative works without explicit written permission.
What you can do: View, download for personal study, and share links to our public content. What you can't do: Copy entire courses, republish our materials, or use them commercially.
4.1 User-Generated Content
If you contribute content to our platform—comments, forum posts, case study responses—you retain ownership of your work. But you grant us a license to use, display, and distribute that content as part of our services.
You warrant that anything you post doesn't infringe on anyone else's intellectual property. If it does, that's on you.
5. Privacy and Data Protection
We take your privacy seriously. Our Privacy Policy (which you should read alongside these terms) explains how we collect, use, and protect your personal information.
By using our services, you consent to our data practices as described in that policy. We comply with Australian privacy legislation, including the Privacy Act 1988 and applicable regulations.
A few key points worth mentioning here:
- We collect information necessary to provide and improve our services
- We don't sell your personal data to third parties
- We use industry-standard security measures to protect your information
- You have rights to access, correct, and request deletion of your data
6. Payment Terms and Refunds
Some of our services require payment. Prices are displayed in Australian dollars and include GST where applicable.
6.1 Billing and Payment
Payment is due at the time of purchase unless otherwise specified. We accept major credit cards and other payment methods as indicated during checkout.
For subscription services, you authorize us to charge your payment method on a recurring basis until you cancel. We'll notify you of any price changes at least 30 days before they take effect.
6.2 Cancellation and Refunds
You can cancel subscriptions at any time through your account settings. Cancellations take effect at the end of your current billing period.
Refund policies vary by service type. For educational programs, we typically offer refunds within 14 days of purchase if you haven't accessed substantial course content. After that point or for completed programs, refunds generally aren't available.
Australian Consumer Law guarantees apply regardless of these terms. If our services fail to meet consumer guarantees, you're entitled to remedies under that legislation.
7. Disclaimers and Limitations
This is the part where we have to be really clear about what we're not promising.
7.1 Educational Purpose
Our services are educational. We're not providing financial advice, and we're not licensed to do so. The concepts, examples, and case studies we present are for learning purposes. They shouldn't be your only basis for making financial decisions.
Financial analysis involves judgment, and different professionals might reach different conclusions from the same data. We teach methodologies and frameworks, but we can't guarantee particular outcomes from applying them.
7.2 No Warranties
We provide our services "as is" and "as available." While we work hard to maintain quality and accuracy, we don't warrant that:
- Our services will be uninterrupted, error-free, or completely secure
- All content will be accurate, complete, or current at all times
- Defects will be corrected immediately or at all
- Our servers are free from harmful components
We make reasonable efforts on all these fronts, but things happen. Technology fails, information changes, humans make mistakes.
7.3 Limitation of Liability
To the fullest extent permitted by law, temoravixi and its directors, employees, and partners won't be liable for indirect, incidental, consequential, or punitive damages arising from your use of our services.
This includes loss of profits, data, or opportunities—even if we've been advised of the possibility of such damages.
Where Australian Consumer Law or other mandatory legislation applies and can't be excluded, our liability is limited to resupplying the services or paying the cost of resupply.
8. Third-Party Links and Services
Our platform might link to third-party websites, resources, or services. These are provided for convenience, not endorsement.
We don't control external sites and aren't responsible for their content, privacy practices, or terms. When you click through to another site, you're subject to their policies, not ours.
If we integrate third-party tools or services into our platform, those integrations are governed by separate terms from those providers. We'll make that clear when relevant.
9. Termination and Suspension
We can suspend or terminate your access to our services if you breach these terms or engage in conduct we reasonably believe is harmful to our platform, other users, or our business.
We'll usually provide notice before termination, but we reserve the right to act immediately in cases involving security threats, illegal activity, or serious violations.
You can terminate your relationship with us at any time by closing your account and stopping use of our services. Some provisions of these terms (like intellectual property protections and liability limitations) survive termination.
9.1 Effect of Termination
Upon termination, your right to access and use our services ends immediately. We'll retain your data as described in our Privacy Policy but aren't obligated to maintain access to content or materials after your account closes.
10. Governing Law and Disputes
These terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. Courts in Canberra, ACT have non-exclusive jurisdiction over disputes arising from these terms.
10.1 Dispute Resolution
If a dispute arises, we'd prefer to resolve it amicably before anyone involves lawyers. Contact us first at contact@temoravixi.com with a detailed description of the issue.
We'll work in good faith to find a resolution within 30 days. If that doesn't work, you retain all legal rights available under Australian law.
Nothing in these terms affects rights under Australian Consumer Law or other mandatory legislation that can't be excluded by contract.
11. General Provisions
11.1 Entire Agreement
These Terms of Use, together with our Privacy Policy and any other legal notices we publish, constitute the entire agreement between you and temoravixi regarding our services.
11.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it valid.
11.3 No Waiver
Our failure to enforce any provision doesn't constitute a waiver of that provision or our right to enforce it later. Waivers must be in writing to be effective.
11.4 Assignment
You can't transfer or assign your rights under these terms without our written consent. We can assign our rights and obligations to any successor entity as part of a merger, acquisition, or sale of assets.
11.5 Force Majeure
We're not liable for delays or failures in performance resulting from circumstances beyond our reasonable control—natural disasters, pandemics, government actions, telecommunications failures, or similar events.
12. Changes to Services
We're constantly improving our platform. That means we might add new features, modify existing ones, or discontinue services that aren't working out.
We'll use reasonable efforts to notify you of significant changes, particularly those affecting paid services. But we can't promise that our services will remain exactly the same over time.
For educational programs you've already enrolled in and paid for, we'll maintain access to that content for a reasonable period even if we discontinue offering the program to new users.
